Fiesta Terms and Conditions Of Sale

Fiesta is committed to providing the highest quality plush, competitive pricing, and outstanding customer service. To help us insure prompt delivery and customer satisfaction, the following terms and conditions apply to all purchases and sales.

Minimum Orders. Unless otherwise agreed, minimum opening order is $150.00. Reorders 200.00.

Pricing.Fiesta�s prices are FOB City of Vernon, California. Prices are subject to change without prior notice. All California orders are subject to applicable taxes unless we receive a valid California tax exemption resale certificate. We regret any typographical errors in our catalogs or price lists, but will not be held responsible for them.

Terms.For customers with established credit of net 30 days, invoices are due 30 days from the billing date. A service charge of 1.5% may be assessed against all amounts 30 days past due. Customers with trade and bank references satisfactory to Fiesta may apply to establish credit. Credit applications are available by fax or mail. Credit Card. Fiesta accepts Visa, Discover, MasterCard, or Check payment in advance.

Returns and Claims. No Goods will be accepted, without a return authorization number. Claims for defective merchandise and/or shortages must be made within 5 days after receipt of Goods. Customer must file all Claims for loss or damage, with Delivery Carrier. All orders refused or returned undeliverable will be billed a $15.00 restocking fee plus freight charges.

Back-orders under $45.00 will be cancelled.

Shipping. Please specify how you would like your order to be shipped. Fiesta normally ships by UPS, FEDEX, DHL or truck line. Fiesta will use the best and most economical carrier, in routing your shipment, due to size, weight factors, or restrictions. All merchandise is shipped FOB, Vernon, CA. USA. Allow 3-4 business days for normal orders to ship. Online rush orders must be called in directly to Fiesta.

Copyright and Trademark. Fiesta enforces its intellectual property rights. All sales are made contingent upon the understanding that Fiesta�s intellectual property rights are entirely reserved by Mahar Manufacturing Corp.

General Legal. Fiesta Concession Corp. shall be entitled to all attorney�s fees and costs incurred in enforcing customer�s obligations, whether or not suit is filed.
